1. The Department of Homeland Security has announced a crackdown on companies who employ illegal workers

5. What is an I-9 Audit and why do I need one now?

Every Employer must complete Form I-9 for every employee in accordance with complex immigration laws or face fines. We recommend an I-9 Audit for every Employer who has received a letter from the Social Security Administration or the Internal Revenue Service advising the Employer that the social security number supplied by an employee does not match their records, called a “No-Match” letter. The receipt of “No-Match” letters for more than one employee signals a potentially serious problem for the Employer and the entire Human Resources Department and immediate action should be taken. The Department of Homeland Security proposed new rules on June 14, 2006 regarding “No-Match” letters. Failure to comply with those new proposed rules could result in the loss of valuable defenses to the employer.

6. How much does an I-9 Audit by your attorneys at my business location cost?

Our basic fee for an Internal I-9 Audit by our attorneys at the Employer’s location in Southern California is $1,500.00, which includes an audit of the records for up to 150 employees. Larger audits are quoted separately. To keep the Employer’s costs reasonable, our attorneys work directly with the Employer’s Human Resources Department to complete specially designed questionnaires designed to streamline the I-9 Audit process. Our attorneys run a computer analysis of the Audit results and present management with a written report of findings and recommendations. Our attorneys also provide written instructions and in-house training for up to five (5) employees as part of the I-9 Audit process so that future problems can be avoided. After the I-9 Audit, our attorneys remain on call for periodic telephone consultation at our standard hourly rate. There is no minimum amount of hourly time an employer needs to use each year.
